The High Court has held that the Bangladesh Public Service Commission may publish a merit list for recommendations to non-cadre posts from the 43rd BCS examination.
In its full judgment, the court said there is no legal obstacle to publishing the list and that the 2023 rules require it.

Several hundred candidates who had passed the written and oral stages challenged steps taken in the 43rd BCS non-cadre recruitment process.
A bench of Justice Shashanka Shekhar Sarkar and Justice Urmi Rahman delivered its judgment on 25 June after hearing the petition.
The PSC had argued during the hearing that recommendations from an earlier BCS could not be made after results of a subsequent BCS had been published.
The court found that the 2023 rules allowed the recommendation process to continue.
It directed the PSC to publish a complete merit list within 60 days.
After publication, recommendations are to begin promptly based on requisitions for vacant government posts, candidates’ preferences and merit.
The judgment does not specify the number of vacant posts or whether the PSC has begun implementing the order.
